مساء يوم امس السبت في مدينة جنيف السويسرية أعمال المؤتمر الدولي حول الأسرى الفلسطينيين،
الذي عقد في مركز المؤتمرات الدولي تحت شعار: «الأسير الفلسطيني بين أحكام القانون
الدولي وغياب تطبيقها»، بمشاركة واسعة من قضاة ومحامين وخبراء في القانون وأكاديميين
وممثلين عن منظمات حقوق الإنسان والمجتمع المدني، إلى جانب محامين متخصصين في الدفاع
عن الأسرى الفلسطينيين.
وشهد المؤتمر
حضورا ومشاركة من فرنسا وبلجيكا وإيطاليا والنمسا وتركيا وفلسطين والأردن والمغرب وتونس
ومصر، فيما عقدت أعماله حضوريا، بالتوازي مع بث مباشر عبر الفيديو، مع توفير الترجمة
الفورية باللغات العربية والفرنسية والإنجليزية.
وسعى المؤتمر
إلى نقل قضية الأسرى الفلسطينيين من إطار التضامن والإدانة إلى مسار قانوني وحقوقي
دولي أكثر فاعلية، يقوم على التوثيق المهني للانتهاكات، وإعداد الملفات القانونية،
وتحديد المسؤوليات، وتفعيل آليات المساءلة أمام الجهات القضائية الدولية والوطنية المختصة.

رسالة إلى المجتمع الدولي
واكتسب
المؤتمر أهمية إضافية من انعقاده في جنيف، بالتزامن مع أعمال الدورة الثالثة والستين
لمجلس حقوق الإنسان التابع للأمم المتحدة، التي بدأت في السابع من أيلول/سبتمبر الجاري
وتستمر حتى السابع من تشرين الأول/أكتوبر 2026.
وأكد منظمو
المؤتمر أن اختيار جنيف يرتبط بمكانتها باعتبارها مركزا دوليا للأمم المتحدة وحقوق
الإنسان، واحتضانها للبعثات الدبلوماسية والمنظمات والمؤسسات الحقوقية الدولية، بما
يوفر فرصة لإيصال ملف الأسرى إلى دوائر صنع القرار الدولي.
كما جاء
انعقاد المؤتمر في ظل تصاعد الاهتمام الدولي بأوضاع الأسرى الفلسطينيين، وما رافق ذلك
من مخاوف حقوقية وقانونية بشأن التطورات المتعلقة بالتشريعات الإسرائيلية الخاصة بعقوبة
الإعدام بحق الأسرى الفلسطينيين.
وشدد المشاركون
على أن وجود قواعد واضحة في القانون الدولي لا يكفي ما لم تقترن بآليات عملية لتنفيذها،
ومحاسبة المسؤولين عن الانتهاكات، وإنهاء حالة الإفلات من العقاب.

وشارك
في المؤتمر عدد من القضاة والمحامين وخبراء القانون والأكاديميين وممثلي منظمات المجتمع
المدني والمؤسسات الحقوقية الدولية، إلى جانب محامين فلسطينيين متخصصين في قضايا الأسرى.
كما برزت
مشاركة محامين دوليين من عدد من الدول الأوروبية، في إطار البحث عن آليات قانونية مشتركة
لتوثيق الانتهاكات وإعداد الملفات وتحريكها أمام الجهات القضائية المختصة.
وشارك
المعهد الدولي العربي للسلام والتربية – جنيف في أعمال المؤتمر، ممثلا بـ الدكتور محمد
أمين أبو الرب ، في إطار الحضور والمشاركة في الفعاليات الدولية المتعلقة بحقوق الإنسان
وقضايا الأسرى.
سبع ساعات
من النقاش القانوني والحقوقي
واستغرقت
أعمال المؤتمر نحو سبع ساعات، توزعت على ثلاث جلسات رئيسية، تناولت الوضع القانوني
للأسرى، والانتهاكات داخل السجون ومراكز الاحتجاز، والآليات الدولية للانتقال من مرحلة
التوثيق إلى المساءلة.

الجلسة
الأولى.. الأسرى الفلسطينيون في منظومة القانون الدولي
حملت الجلسة
الأولى عنوان:
«الأسرى
الفلسطينيون في منظومة القانون الدولي: الوضع القانوني وحدود سلطة الاحتلال».
وناقشت
المركز القانوني للأسرى والمعتقلين الفلسطينيين في ضوء اتفاقيات جنيف وقواعد القانون
الدولي الإنساني والقانون الدولي لحقوق الإنسان، ومسؤوليات سلطات الاحتلال تجاه الأسرى،
وحدود سلطتها في الاعتقال والاحتجاز.
كما تناولت
الجلسة ملف الاعتقال الإداري والاحتجاز التعسفي، والضمانات القانونية المتعلقة بالحرية
والحق في الحياة، إضافة إلى المسؤولية الدولية للدول والجهات المعنية عن حماية الأسرى
وضمان حقوقهم.
الجلسة
الثانية.. من الوقائع الموثقة إلى التكييف القانوني
جاءت الجلسة
الثانية تحت عنوان:
«أنماط
الانتهاكات داخل السجون ومراكز الاحتلال: من الوقائع الموثقة إلى التكييف القانوني».
وتناولت
ما وصفه المشاركون بالانتهاكات التي يتعرض لها الأسرى داخل السجون ومراكز الاحتجاز،
بما في ذلك التعذيب وسوء المعاملة، والإهمال الطبي، والحرمان من العلاج، والوفيات داخل
السجون.
كما بحثت
الجلسة أوضاع الأطفال والنساء المعتقلين، وأهمية توفير الحماية الخاصة لهم وفقا للقواعد
والمعايير الدولية.
وتطرق
المشاركون كذلك إلى أهمية الانتقال من الشهادة الفردية إلى بناء صورة متكاملة لأنماط
الانتهاكات، من خلال جمع شهادات الأسرى والمحررين والعائلات والمحامين، وربطها بالوثائق
والتقارير الطبية والأدلة الأخرى.
كما أثير
خلال المؤتمر ملف أسرى لبنانيين وسوريين، وما يتعرضون له، بحسب الشهادات والمعلومات
التي عرضت، من سوء معاملة وتجويع وضرب وإهانة واحتجاز إداري، وسط دعوات إلى توثيق هذه
الحالات والتحقق منها وفقا للمعايير القانونية.

الثالثة.. من التوثيق إلى المساءلة
أما الجلسة
الثالثة فحملت عنوان:
«من التوثيق
إلى المساءلة: الآليات الدولية لملاحقة الانتهاكات بحق الأسرى».
وركزت
على كيفية تحويل المعلومات والشهادات والوثائق إلى ملفات قانونية يمكن الاستناد إليها
أمام الجهات القضائية المختصة.
وناقش
المشاركون دور الأمم المتحدة، واللجنة الدولية للصليب الأحمر، والبرلمانات الأوروبية،
والجهات القضائية الدولية والوطنية، إضافة إلى إمكانية الاستفادة من آليات الاختصاص
القضائي العالمي في الدول التي تسمح قوانينها بذلك.
كما جرى
التأكيد على أهمية بناء ملف إثبات متكامل يحافظ على سلامة الأدلة وتسلسل حيازتها، ويتيح
إسناد المسؤولية إلى الجهات والأشخاص المعنيين وفقا للمعايير القانونية.
من التوثيق
إلى الملفات القضائية
ومن أبرز
الأفكار التي طرحت خلال المؤتمر العمل على بناء شبكة قانونية دولية تضم محامين فلسطينيين
ودوليين، بهدف تنسيق جهود التوثيق وإعداد الملفات القانونية ومتابعة المسارات القضائية
المتاحة.
وأكد المشاركون
أن التوثيق المهني يمثل الأساس لأي مسار قضائي، وأن الشهادات الفردية تحتاج إلى التحقق
والتنظيم وربطها بالوثائق والأدلة والتقارير الطبية وغيرها من المواد التي يمكن أن
تشكل أساسا لملفات قانونية.
كما جرى
بحث مسارين رئيسيين للمساءلة، يتمثلان في المحكمة الجنائية الدولية، والاستفادة من
قوانين الاختصاص القضائي الوطني في بعض الدول الأوروبية، وفقا للشروط والمتطلبات القانونية
المعمول بها في كل دولة.
البعد
الدبلوماسي والإعلامي
لم يقتصر
النقاش على الجانب القضائي، بل تناول المشاركون أيضا المسار الدبلوماسي والدولي لقضية
الأسرى، ودور مجلس حقوق الإنسان والأمم المتحدة والبرلمانات الأوروبية في تعزيز الحماية
الدولية للأسرى.
كما ناقش
المؤتمر معركة الرواية والوعي الدولي، وأهمية بناء خطاب حقوقي وإعلامي مهني قادر على
إيصال قضية الأسرى إلى الرأي العام العالمي، وتعزيز المناصرة الدولية لقضيتهم.

المؤتمر أعماله ببيان وتوصيات أعلن منظموه أنهم يعتزمون إيصالها إلى الأمم المتحدة
والبرلمانات والجهات القضائية والحقوقية المعنية.

ويرى المشاركون
أن التحدي الحقيقي يبدأ بعد انتهاء المؤتمر، من خلال ترجمة التوصيات إلى عمل مؤسسي
مستمر، وتوثيق الانتهاكات بصورة مهنية، وإعداد ملفات قانونية قابلة للتقديم أمام الجهات
المختصة، ومتابعة المسارات الدولية والوطنية الممكنة.
كما يبرز
الهدف المعلن ببناء ائتلاف قانوني وحقوقي دولي مستدام يجمع المحامين والمؤسسات الحقوقية
والجهات البرلمانية والدبلوماسية، بما يضمن استمرار العمل على قضية الأسرى وعدم بقائها
رهينة البيانات والإدانات.
وبذلك
حمل مؤتمر جنيف رسالة واضحة مفادها أن قضية الأسرى الفلسطينيين تتطلب، إلى جانب التضامن
الإنساني، مسارا قانونيا قائما على التوثيق والإثبات وتحديد المسؤولية والمساءلة، وأن
الانتقال من الحديث عن الانتهاكات إلى بناء الملفات القضائية يمثل التحدي الأبرز للمرحلة
المقبلة.
Geneva International Conference Opens Legal Battle to Hold the Occupation
Accountable for Violations Against Palestinian Prisoners

The International Conference on
Palestinian Prisoners concluded on Saturday evening in the Swiss city of
Geneva. The conference was held at the International Conference Centre under
the theme: "The Palestinian Prisoner Between the Provisions of International
Law and the Absence of Their Implementation.” It brought together a wide
range of judges, lawyers, legal experts, academics, representatives of human
rights and civil society organizations, as well as lawyers specializing in the
defense of Palestinian prisoners.
The conference was attended by
participants from France, Belgium, Italy, Austria, Türkiye, Palestine, Jordan,
Morocco, Tunisia and Egypt. The proceedings were held in person, alongside a
live video broadcast, with simultaneous interpretation provided in Arabic,
French and English.
The conference sought to move the
issue of Palestinian prisoners beyond solidarity and condemnation toward a more
effective international legal and human rights process based on professional
documentation of violations, the preparation of legal files, the identification
of responsibility, and the activation of accountability mechanisms before
competent international and national judicial bodies.
Geneva: A Message to the International Community
The conference gained additional
significance from being held in Geneva alongside the 63rd session of the United
Nations Human Rights Council, which began on 7 September 2026 and is scheduled
to continue until 7 October 2026.
The organizers emphasized that Geneva
was chosen because of its status as an international center for the United
Nations and human rights, as well as its hosting of diplomatic missions and
international human rights organizations and institutions. This provides an
opportunity to bring the prisoners’ issue to the attention of international
decision-making circles.
The conference also took place amid
growing international concern over the conditions of Palestinian prisoners and
human rights and legal concerns surrounding developments related to Israeli
legislation concerning the death penalty for Palestinian prisoners.
Participants stressed that the
existence of clear rules under international law is insufficient unless
accompanied by practical mechanisms for implementation, accountability for
those responsible for violations, and an end to impunity.
Broad Legal and Human Rights Participation
The conference brought together
judges, lawyers, legal experts, academics, representatives of civil society
organizations and international human rights institutions, as well as
Palestinian lawyers specializing in prisoners’ cases.
International lawyers from several
European countries also participated, seeking to explore joint legal mechanisms
for documenting violations, preparing case files and pursuing them before
competent judicial authorities.
The International Arab Institute
for Peace and Education – Geneva participated in the conference,
represented by Dr. Mohammad Amin Abu Al-Rub, as part of its
participation in international activities addressing human rights and
prisoners’ issues.
Seven Hours of Legal and Human Rights Discussions
The conference lasted approximately
seven hours and was divided into three main sessions addressing the legal
status of prisoners, violations inside prisons and detention centers, and
international mechanisms for moving from documentation to accountability.
Key Issues Discussed in the Three Sessions and Final Recommendations
First Session: Palestinian Prisoners under International Law
The first session was entitled:
"Palestinian Prisoners under
International Law: Legal Status and the Limits of the Occupying Power’s
Authority.”
The session examined the legal status
of Palestinian prisoners and detainees in light of the Geneva Conventions,
international humanitarian law and international human rights law. It also
addressed the responsibilities of the occupying authorities toward prisoners
and the limits of their powers regarding arrest and detention.
The session further discussed
administrative detention and arbitrary detention, legal guarantees concerning
liberty and the right to life, as well as the international responsibility of
states and relevant parties to protect prisoners and guarantee their rights.
Second Session: From Documented Facts to Legal Characterization
The second session was entitled:
"Patterns of Violations Inside Prisons
and Occupation Detention Centers: From Documented Facts to Legal
Characterization.”
It examined what participants
described as violations against prisoners inside prisons and detention centers,
including torture and ill-treatment, medical neglect, denial of medical care,
and deaths in detention.
The session also addressed the
conditions of detained children and women and the importance of providing them
with special protection in accordance with international rules and standards.
Participants discussed the importance
of moving beyond individual testimonies toward constructing a comprehensive
picture of patterns of violations by collecting testimonies from prisoners and
former detainees, families and lawyers, and linking them to documents, medical
reports and other forms of evidence.
The conference also addressed the
situation of Lebanese and Syrian prisoners and what was presented, according to
testimonies and information discussed, as allegations of ill-treatment,
starvation, beatings, humiliation and administrative detention. Calls were made
for such cases to be documented and independently verified in accordance with
legal standards.
Third Session: From Documentation to Accountability
The third session was entitled:
"From Documentation to Accountability:
International Mechanisms for Pursuing Violations Against Prisoners.”
It focused on how information,
testimonies and documents can be transformed into legal case files that may be
submitted to competent judicial authorities.
Participants discussed the role of the
United Nations, the International Committee of the Red Cross, European
parliaments, international and national judicial authorities, as well as the
potential use of universal jurisdiction mechanisms in countries whose laws
permit such proceedings.
The importance of building a
comprehensive evidentiary file that preserves the integrity of evidence and its
chain of custody was also emphasized, enabling responsibility to be attributed
to the relevant individuals and entities in accordance with legal standards.
From Documentation to Judicial Case Files
One of the key proposals presented at
the conference was the establishment of an international legal network bringing
together Palestinian and international lawyers to coordinate documentation
efforts, prepare legal case files and pursue available judicial avenues.
Participants emphasized that
professional documentation constitutes the foundation of any judicial process
and that individual testimonies require verification, organization and linkage
to documents, medical reports and other materials capable of forming the basis
of legal files.
Two principal accountability avenues
were also discussed: proceedings before the International Criminal Court,
and the use of national jurisdiction laws in certain European countries,
subject to the legal conditions and requirements applicable in each country.
The Diplomatic and Media Dimensions
The discussions were not limited to
the judicial dimension. Participants also addressed the diplomatic and
international dimensions of the prisoners’ issue and the role of the Human
Rights Council, the United Nations and European parliaments in strengthening
international protection for prisoners.
The conference also examined the
battle over narrative and international awareness, emphasizing the importance
of developing a professional human rights and media discourse capable of
communicating the prisoners’ issue to global public opinion and strengthening
international advocacy on their behalf.
Final Recommendations
The conference concluded with a
statement and a set of recommendations. Its organizers announced their
intention to convey them to the United Nations, parliaments, judicial bodies
and relevant human rights institutions.
Among the key recommendations
presented were affirming that prisoners’ freedom is a matter of human rights
and dignity; working to halt the expansion of administrative detention and
arbitrary detention; criminalizing torture and ill-treatment of prisoners;
guaranteeing prisoners’ right to medical treatment and humane conditions;
ending impunity and pursuing those responsible for violations; continuing
judicial efforts before competent international and national courts; providing
special protection for women and children held in detention; documenting
violations in accordance with the Geneva Conventions and relevant international
rules; preparing comprehensive legal files and submitting them to the United
Nations and competent judicial authorities; activating international human
rights mechanisms, special procedures and commissions of inquiry; strengthening
the role of lawyers abroad and supporting the legal efforts of Palestinian
lawyers; urging European parliaments and diplomatic institutions to assume their
responsibilities toward the prisoners’ issue; and establishing a sustainable
international legal and human rights coalition and network to follow up on the
issue.
From a Conference to a Sustainable International Process
The conference comes within an effort
to reframe the issue of Palestinian prisoners as a matter of international law
and human rights rather than solely a matter of political or humanitarian
solidarity.
Participants believe that the real
challenge begins after the conference concludes, through translating its
recommendations into sustained institutional action, professionally documenting
violations, preparing legally viable case files, and pursuing available
international and national legal avenues.
The stated objective of establishing a
sustainable international legal and human rights coalition bringing together
lawyers, human rights institutions, parliamentary bodies and diplomatic actors
also remains central, ensuring that work on the prisoners’ issue continues
rather than remaining confined to statements and condemnations.
The Geneva conference therefore
delivered a clear message: the issue of Palestinian prisoners requires,
alongside humanitarian solidarity, a legal process based on documentation,
evidence, identification of responsibility and accountability. The transition
from speaking about violations to building judicial case files represents the
principal challenge for the next phase.
